By accessing or using the TradeVolly platform ("Platform"), you ("User") agree to be legally bound by these Terms of Service ("Terms"). If you do not agree, you must immediately discontinue use. These Terms apply to all users, including registered traders, buyers, sellers, visitors, and any person who accesses the Platform in any capacity. Your continued use of the Platform following any modification to these Terms constitutes your binding acceptance of the revised Terms.
You must be at least 18 years of age to use TradeVolly. By using the Platform, you represent and warrant that: (a) you are at least 18 years old; (b) you have the legal capacity to enter into binding contracts; (c) you are not barred from using the Platform under any applicable law; and (d) all information you provide is accurate, current, and complete. TradeVolly reserves the right to terminate any account upon discovering a violation of this eligibility requirement.
TradeVolly is a peer-to-peer, member-based platform that facilitates trades and sales of physical goods between users. TRADEVOLLY IS NOT A PARTY TO ANY TRANSACTION between users. We are not a buyer, seller, shipper, insurer, or financial institution. TradeVolly does not own, inspect, authenticate, guarantee, or warrant any item listed on the Platform, and we do not pre-screen or pre-approve listings before they go live. Our model is built on trust: we set the tone, and the community keeps it honest. Members are the first line of oversight — any member can flag a listing that doesn't belong, and founding members and regional founders help keep their local stations in line. TradeVolly does not act as a "big brother" monitoring every post; instead, we provide the tools — escrow, shipping, messaging, and a reporting system — and we step in when a dispute or escrow release needs a tiebreaker. We provide infrastructure to support user transactions, but all responsibility for the condition, accuracy, and delivery of items rests solely with the transacting parties.
All payment processing and fund custody on TradeVolly is performed exclusively by Stripe, Inc., a licensed payment processor. TradeVolly does not hold, custody, or transmit user funds. TradeVolly is NOT a bank, money services business, or licensed money transmitter. By using payment features on the Platform, you also agree to Stripe's Terms of Service (stripe.com/terms). Escrow funds will be held pending confirmation of receipt by both parties or resolution of any active dispute. TradeVolly is not liable for delays, errors, or failures attributable to Stripe or third-party payment networks. Disbursement of Seller Funds: Once escrow is released under these Terms (and under Section 11), the sale proceeds, minus the flat $1 platform fee, are paid out to the seller's connected Stripe Connect account via a Stripe Transfer, and then to the seller's bank account by Stripe. TradeVolly schedules and triggers the release; it does not custody or transmit seller funds. Sellers must complete Stripe Connect onboarding on the Platform to receive payouts; a seller without a connected account will not be paid until onboarding is complete.
The Local Trading Post feature allows buyers to pay a $1 contact unlock fee to receive temporary contact information for a seller. By using this feature: (a) TradeVolly acts solely as an introduction facilitator and assumes no responsibility for any transaction, communication, or outcome that occurs outside the Platform; (b) users agree to meet only in safe, public locations; (c) TradeVolly expressly disclaims all liability for fraud, theft, injury, or any harm arising from off-platform interactions; (d) the $1 unlock fee is non-refundable once contact information has been disclosed; and (e) users may not use revealed contact information for any purpose other than completing the specific listed transaction.
T-Volly Coins and TradeVolly Tokens are loyalty and engagement reward points issued solely at TradeVolly's discretion. THESE ARE NOT SECURITIES, INVESTMENTS, CURRENCY, OR FINANCIAL INSTRUMENTS of any kind. They have no guaranteed monetary value, are not redeemable for cash except as expressly provided by TradeVolly at its sole discretion, are non-transferable, non-sellable, and have no value outside the Platform. Current Reward Mechanics (Disclosed for Transparency): The following figures describe how the rewards program currently operates. They are published here and on the Platform so members always know the current rules. TradeVolly may modify, suspend, or discontinue any of these mechanics at any time in its sole discretion with notice where practicable under Section 19; your continued use of the Platform after any such change constitutes acceptance of the updated mechanics. • New-Member Welcome: When you join TradeVolly, you receive one (1) free TradeVolly Token (a $1 welcome credit) and one (1) one-time "New Member Bonus" activity point, granted once per member account upon joining. • Tokens: TradeVolly Tokens are valued at $1 USD each and may be purchased through the Platform. Tokens may be spent in the T-Volly Station and to cover trade fees. • Activity Points & Coins: You earn activity points by contributing to the community. Every twenty (20) activity points equals one (1) T-Volly Coin. • Earning Activities (point values): List an Item = 1 point; Complete a Trade = 3 points; Sell an Item = 2 points; Refer a Friend who completes their first trade = 5 points; Leave a Review = 1 point; New Member Bonus = 1 point (one-time). • Coin Value: Each T-Volly Coin's current illustrative value is $1 USD. Coin value is not guaranteed and may grow, or change, as the Platform evolves. • Founder Lock: T-Volly Coins earned during the founding period are locked for six (6) months from the date they are earned before they may be redeemed. • Founder Coins & Platform Growth: Founder Coins and Founding Member status are specifically tied to TradeVolly's success over time. The amount earned through the Founder Coin program is not a fixed or guaranteed value — it is adjusted based on the growth and evolution of the TradeVolly platform. Founder Coins represent a member's contribution to building TradeVolly during its early stages; their ultimate value, if any, depends on the platform's long-term growth and success. TradeVolly may adjust founder coin values, tier thresholds, and redemption mechanics as the platform scales. Holding Founder Coins does not guarantee any specific payout, cash value, or return. • Trial & Error Period: TradeVolly is currently in its trial and error stages. Features, reward calculations, and platform mechanics may change as we identify and resolve issues. Founding members are encouraged to report problems through the in-app Advice Board, including the relevant Transaction ID, so that discrepancies can be traced and resolved through the audit system. • Platform Fee: A flat $1 platform fee applies to each completed trade or sale (see Section 9). The current mechanics above describe how the program operates today; they are not guarantees that any particular value, ratio, or earning rate will remain unchanged, and the program may be modified as described above and in Section 19. Activity points and coins are credited only for verified activity on the Platform; creating duplicate accounts, farming listings, or otherwise manipulating the reward system is prohibited and may result in forfeiture and account termination. Coins and tokens may expire, be forfeited, or be revoked in the event of account termination or violation of these Terms. Future Investment Products: TradeVolly may in the future offer separate, formally structured investment or equity participation products ("Investment Products") that are entirely distinct from the loyalty coin and token reward program described above. Any such Investment Products would be offered under separate terms, disclosures, and applicable regulatory frameworks, and would not alter, enhance, or retroactively apply to T-Volly Coins or TradeVolly Tokens earned under the current rewards program. Holding T-Volly Coins or Tokens does not entitle any user to participate in, convert to, or benefit from any future Investment Products. Nothing in these Terms or in TradeVolly's marketing materials should be construed as a promise, offer, or representation that any future Investment Product will be made available.
TradeVolly utilizes AI-powered features including the Volly companion, smart reply suggestions, CoPilot item matching, and pricing analytics ("AI Features"). ALL AI-GENERATED CONTENT IS PROVIDED FOR INFORMATIONAL CONVENIENCE ONLY and does not constitute professional advice of any kind — including but not limited to legal, financial, valuation, or appraisal advice. AI suggestions may be inaccurate, incomplete, or inappropriate for your specific situation. TradeVolly expressly disclaims all liability for any reliance on AI-generated suggestions. Users assume full responsibility for all decisions made in connection with AI Feature outputs.
All listings must accurately describe items including condition, defects, and any material facts. You may not list: weapons or firearms; illegal goods or controlled substances; counterfeit or stolen items; hazardous materials; adult content; items infringing third-party intellectual property; live animals; or any item whose sale or transfer is prohibited by applicable law. TradeVolly does not pre-screen or pre-approve listings before they appear on the marketplace. Listings go live immediately when posted. The community — members, founding members, and regional founders — serves as the first line of oversight. Any member may report a listing that violates these standards, and TradeVolly will review reported listings and may remove them at its sole discretion. This member-driven model is intentional: we trust adults to act like adults, and we rely on the community to flag what doesn't belong rather than monitoring every post. Users are solely responsible for ensuring their listings comply with all applicable laws.
Once a trade offer is accepted by both parties, a binding agreement is formed between those users. TradeVolly is not a party to that agreement. Cancellations after acceptance may result in account penalties, reduced trust ratings, and potential loss of platform privileges. TradeVolly charges a flat $1 platform fee on each completed trade or sale. New traders (fewer than 3 completed trades) may be required to submit a deposit on trades exceeding $100 to protect against abandonment.
TradeVolly provides prepaid shipping label generation via EasyPost. Users are solely responsible for: (a) packaging items securely and appropriately; (b) shipping within 3 business days of trade confirmation; (c) ensuring items match their listing description before shipment. TradeVolly is not liable for items lost, damaged, or delayed in transit. All shipping carrier claims must be filed directly with the applicable carrier. Failure to ship within the required window may result in trade cancellation and account penalties.
If you have an issue with a received item, you must open a dispute within 48 hours of confirmed delivery. TradeVolly will review submitted evidence and make a determination regarding escrow release. TradeVolly's dispute decisions are FINAL AND BINDING and are made at our sole discretion. TradeVolly is not liable for incorrect determinations made in good faith. Our liability in any dispute is strictly limited to the escrow amount held for that specific transaction. We do not guarantee any particular outcome.
PLEASE READ THIS SECTION CAREFULLY. ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL BE RESOLVED EXCLUSIVELY THROUGH BINDING INDIVIDUAL ARBITRATION, and not in any court. You waive your right to participate in any class action lawsuit or class-wide arbitration. Arbitration shall be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in Maricopa County, Arizona. This clause does not prevent either party from seeking emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. TradeVolly does not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses. We do not guarantee the quality, condition, legality, or accuracy of any listing or the conduct of any user.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRADEVOLLY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including lost profits, data loss, or personal injury, arising from your use of the Platform. TradeVolly's total aggregate liability for any claim shall not exceed the greater of: (a) the fees paid by you to TradeVolly in the 90 days preceding the claim, or (b) $100 USD. Some jurisdictions do not allow certain liability limitations, so some of the above may not apply to you.
You agree to defend, indemnify, and hold harmless TradeVolly and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising out of or relating to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party right; (d) any item you list, trade, or sell; or (e) any off-platform activity initiated through the Platform.
All content, branding, design, technology, and features of the Platform are owned by TradeVolly or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our express written consent. By uploading content to the Platform, you grant TradeVolly a worldwide, royalty-free, non-exclusive license to use, display, and process that content solely for operating and improving the Platform, including for AI matching and smart features.
All users must comply with TradeVolly's Community Standards at all times. Prohibited conduct includes harassment, fraud, off-platform solicitation to circumvent fees, manipulation of ratings, identity fraud, and any use of the Platform for illegal purposes. TradeVolly reserves the right to suspend or permanently terminate any account, at its sole discretion, with or without notice, for violations of these Terms or for any conduct that TradeVolly determines to be harmful to the Platform or its users. Terminated users may not re-register without express written permission.
These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict of law principles. Subject to the arbitration clause above, any litigation shall be brought exclusively in the state or federal courts of Maricopa County, Arizona, and you consent to personal jurisdiction in those courts.
TradeVolly reserves the right to modify these Terms at any time. Material changes will be communicated via the Platform or email with at least 7 days notice where practicable. Your continued use of the Platform after such changes constitutes your binding acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform immediately.
TradeVolly may send push notifications to your mobile device to alert you about activity on the Platform, including when a buyer expresses interest in your item, trade and offer updates, new messages, shipping status, and other transactional events. By installing and using the TradeVolly mobile app, you consent to receiving these push notifications. You may disable push notifications at any time through your device's operating system settings (iOS Settings or Android app notification settings). Disabling push notifications does not affect your ability to use the Platform; however, you may miss time-sensitive trade and message alerts.

Your account is yours to control. You may request deletion of your TradeVolly account at any time through our Account Deletion process (see the section at the bottom of this page). Important: Deleting your account will NOT remove your prior activity within TradeVolly's public trading grounds. Completed trades, public marketplace activity, and community contributions remain part of the platform's shared record and are not erased when your account is deleted. Data Sharing — Outside Parties: None of your personal information or platform activity will be shared with any outside parties. Only TradeVolly administrators have access to account and activity data, and solely as needed to operate and maintain the platform and to resolve disputes. TradeVolly does not sell or disclose your personal information to third parties.
